When a Customer contacts Don't Need No Samurai through any of the above methods, Don't Need No Samurai may ask the Customer to provide additional information and Personal Data in order to respond. Providing information and Personal Data is voluntary but may be necessary to perform actions or obtain information of interest to the Customer. When a Customer contacts Don't Need No Samurai via a form, Don't Need No Samurai may ask the Customer to provide Personal Data to verify the Customer's identity and enable contact regarding the matter.

Don't Need No Samurai stores correspondence with Customers for the purpose of responding to inquiries, handling complaints, and for statistical purposes. Personal Data processed in this manner will not be used to communicate with the Customer for any purpose other than handling the inquiry.

Any commercial information related to Don't Need No Samurai's activities may only be sent in accordance with the Customer's prior consent given for the purpose of concluding and performing the Newsletter service agreement.

Personal Data

Personal Data as used in this Privacy Policy means information about an identified or identifiable natural person (hereinafter referred to as "Personal Data"). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as: name, identification number, location data, online identifier, or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

Customer (User)

For the purposes of this Privacy Policy, a Customer is any legal entity that uses the Website. Depending on the purposes of using the Website, certain information regarding Personal Data will be intended only for specific categories of Customers – i.e., only for Users who use the Website functionality without logging in, or only for Users who use an Account on the Website.

Processing of Personal Data

This Privacy Policy applies to all Customer Personal Data that is considered processed under applicable law. Don't Need No Samurai processes Personal Data in accordance with the Act of May 10, 2018 on the Protection of Personal Data (Journal of Laws of 2018, item 1000) and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (Official Journal of the EU L No. 119, p. 1) (hereinafter also referred to as "GDPR"), as well as the Act of July 18, 2002 on the Provision of Electronic Services (Journal of Laws 2020.344, consolidated text of March 3, 2020).

Don't Need No Samurai implements appropriate technical and organizational measures to ensure the protection of processed Personal Data, including software safeguards (such as data encryption systems) adequate to the risks and categories of data being protected. In particular, we protect Personal Data against unauthorized access, processing in violation of applicable regulations, and alteration, loss, damage, or destruction. Don't Need No Samurai maintains constant control over the Personal Data processing process and limits access to Personal Data to the greatest extent possible.

Don't Need No Samurai takes special care to protect the interests of data subjects and, in particular, ensures that collected Personal Data is:

processed lawfully, fairly, and in a transparent manner in relation to the data subject;
collected for specified, explicit, and legitimate purposes and not further processed in a manner incompatible with those purposes;
adequate, relevant, and limited to what is necessary in relation to the purposes for which it is processed;
accurate and, where necessary, kept up to date;

Scope and Purposes of Personal Data Processing

Taking into account applicable regulations and, above all, the security of Customers' Personal Data, in each case of Personal Data processing, the purpose and scope of data processing result from the Customer's consent or legal provisions and are further specified as a result of Customer actions on the Website or through other customer communication channels.

Don't Need No Samurai protects the Personal Data of Customers, visitors to the Online Store, and persons who share Personal Data through other communication channels. In particular, Don't Need No Samurai protects the Personal Data of users of www.facebook.com and all other websites marked or co-branded with the Facebook brand, the operating principles of which are based on the provisions of: https://www.facebook.com/legal/terms, provided respectively by Facebook Inc. or Facebook Ireland Limited, including through the Facebook Lead Ads feature for the purpose of direct marketing of Don't Need No Samurai's own products or services. Don't Need No Samurai may process Personal Data provided in contact forms, transmitted during use of the Website, including during use of the Account, submitted in connection with inquiries and complaints, in the Newsletter subscription form, when leaving reviews, as well as other data obtained based on Customer activity on the Website. Don't Need No Samurai may process Personal Data obtained through the Website or other customer communication channels, including data automatically processed during use of the Website, to the extent that information obtained through the technology used may be considered Personal Data (data on Website usage, operating system version data, screen resolution data, data collected using cookies or other technologies used to track Customer activity, device IP data, location data, web browser data).

Don't Need No Samurai may therefore process the following Customer Personal Data: first and last name, username, email address, contact phone number, delivery address (street, house number, apartment number, postal code, city, country), residential/business/registered office address (if different from the delivery address), bank account number. Additionally, the following Personal Data may be collected: information contained in the User's profile, confirmation of private User status, Account preferences, IP address, operating system, browser type, browser version, browser configuration, Internet provider name, and other information regarding computer type and Internet connection used to identify the device type, establish a connection to the Website, enable data exchange, URL and IP address of the website from which the Customer entered or was redirected to the Website with date and time, full click history in the form of URLs with date and time, subpages visited on the Website, links accessed with date and time, service inquiries and placed orders, purchase history, completed and pending transactions, searched phrases, products, services, shopping cart, wishlist, and payment information.

Don't Need No Samurai processes Personal Data only for the following purposes:

enabling the placement of orders for products and services on the Website and processing orders;
handling complaints and any other claims;
enabling personalized use of the Website (including customizing offer content to Customer preferences);
managing, operating, maintaining, and improving the Website;
conducting analysis and research on Customer behavior;
presenting Customer reviews of products;
responding to Customer questions and handling requests sent to Don't Need No Samurai;
enabling Customers to receive information about products and services via email, phone, Newsletter, SMS, and MMS messages (direct marketing);
presenting tailored advertisements and messages and improving the quality of presented advertisements and messages, with this purpose being achieved using cookies;
sending dedicated messages to Customers (e.g., sending reminders, technical information, updates, security warnings, administrative messages, and service bulletins);
enabling prize distribution, sending surveys, information about lotteries, contests, or other promotional activities;
for the purpose of performing the Newsletter service agreement, Personal Data may also be processed for marketing purposes of products or services of entities with which Don't Need No Samurai cooperates.

Don't Need No Samurai will notify the Customer of its intention to use Personal Data for purposes other than those listed in the Privacy Policy if required by applicable regulations, and the use of Personal Data for such purposes will occur after the Customer's consent is obtained.

Legal Basis for Personal Data Processing by Don't Need No Samurai

Personal Data is processed as described in this Privacy Policy. Personal Data is not used for other purposes unless the Customer has consented or it is required or permitted by law. The Controller processes Personal Data based on the following grounds:

necessity to perform a contract to which the Customer is a party or to take steps at their request prior to entering into a contract (pursuant to Article 6(1)(b) GDPR), including order fulfillment, settlements, communication related to service provision, conclusion of an electronic services agreement, conclusion of a sales agreement, conclusion of a Newsletter service agreement;
legitimate interest of Don't Need No Samurai (pursuant to Article 6(1)(f) GDPR) – responding to Customer questions and handling messages sent to Don't Need No Samurai via the form available on the Website in the "Contact" tab or via chat and in connection with product reviews, improving the ordering service via the Website; securing the pursuit of potential claims and defense against claims in connection with Don't Need No Samurai's business activities; handling complaints; creating analyses and compilations for internal needs; managing, operating, maintaining, and improving the Website; informing Customers about updates or changes to services; customizing Website content or offers to individual Customer preferences; conducting analysis and research on Customer behavior, including marketing research or surveys regarding individual Customer needs and opinions on sales and Don't Need No Samurai's marketing activities, both anonymously (e.g., through mass data collection) and individually (through direct correspondence with Customers – only when marketing consent has been given);
Customer consent (pursuant to Article 6(1)(a) GDPR) – to the extent that the Customer consents to the presentation, creation, granting, and implementation of advertisements, offers, or promotions (discounts) dedicated to the Customer, which are based solely on automated processing, including profiling, that may significantly affect the Customer's consumer decisions;
Customer consent (pursuant to Article 6(1)(a) GDPR) – to the extent that the Customer consents to the publication of their product review via the Website and consents to the processing of personal data in connection with such review. The content of the review and username are subject to publication. Consent to the processing of personal data in connection with the publication of a review may be withdrawn at any time, but this does not affect the lawfulness of processing carried out before the withdrawal of consent;
fulfillment of obligations imposed under tax and accounting regulations (pursuant to Article 6(1)(c) GDPR and applicable tax or accounting regulations) to the extent that Don't Need No Samurai processes Personal Data in fulfillment of tax obligations (maintaining accounting books, issuing accounting documents).

To the extent that Don't Need No Samurai's partners may have direct access to Customers' personal data, the legal basis for such processing is the Customer's voluntary consent (Article 6(1)(a) GDPR).

For other purposes, Customer Personal Data may be processed on the basis of:

voluntarily given consents (Article 6(1)(a) GDPR);
applicable legal provisions (Article 6(1)(c) GDPR);
necessity for purposes other than those mentioned above resulting from legitimate interests pursued by Don't Need No Samurai (Article 6(1)(f) GDPR).

Don't Need No Samurai will notify Customers of its intention to use personal data for purposes other than those listed in the Privacy Policy if required by applicable regulations, and the use of personal data for such purposes will occur after the Customer's consent is obtained.

Voluntary Provision of Personal Data

Don't Need No Samurai always indicates which Personal Data is required for the provision of specific services or for entering into the relevant agreement.

Providing Personal Data in the Online Store by the Customer is voluntary, with the reservation that providing such data is necessary to use certain functionalities of the Online Store, including to conclude and perform the Sales Agreement, register an Account, or conclude and perform the Service Agreement.

Failure to provide Personal Data may result in the inability to effectively perform the above actions.

Providing Personal Data as required by the contact form and chat (name and email address) is voluntary but necessary to contact the Customer and provide a response. Providing a contact phone number is voluntary and not necessary to contact the Customer and provide a response. Providing other (non-required) Personal Data is voluntary.

Providing Personal Data as required for product reviews (username) is voluntary but necessary to post a review on the Website. The content of the review and username are subject to publication. Consent to the processing of Personal Data in connection with the publication of a review may be withdrawn at any time, but this does not affect the lawfulness of processing carried out before the withdrawal of consent.

Providing Personal Data as required for the Newsletter service (email address) is voluntary but necessary to provide the Newsletter service.

Transfer of Customer Personal Data to Third Parties

Don't Need No Samurai does not sell, exchange, rent, disclose, transfer, or otherwise make available Customer Personal Data, except where the Customer has given prior consent and except in the circumstances described below.

Don't Need No Samurai may transfer Customer Personal Data to the following entities:

the selected carrier or intermediary handling shipments on behalf of Don't Need No Samurai – in the case of a Customer who uses postal or courier delivery in the Online Store;
the selected entity handling payments in the Online Store – in the case of a Customer who uses electronic payments or payment cards in the Online Store;
providers of hosting or IT services, software maintenance companies, companies supporting Don't Need No Samurai in marketing campaigns, as well as providers of legal and advisory services;
entities using cookies in the Online Store;
providers of legal services (in particular law firms and debt collection companies) and audit and advisory services;
other entities to which Don't Need No Samurai has entrusted Personal Data processing while maintaining full guarantees of Customer Personal Data security.

In each case, the catalog of recipients of personal data processed by Don't Need No Samurai results primarily from the scope of services used by the Customer and the Customer's consent, or from legal provisions, and is further specified as a result of Customer actions in the Online Store.

Personal Data may be disclosed by Don't Need No Samurai if necessary to protect the rights or security of Don't Need No Samurai, other Customers, or third parties – in the course of complying with legal provisions.

Transfer of Customer Personal Data to Third Countries (Outside the European Economic Area)

Collected Personal Data is stored and processed within the European Economic Area (hereinafter also: EEA), with the reservation that information obtained through cookies may be stored outside the EEA, and in exceptional cases, the full IP address may be transferred outside the EEA and truncated there. Personal Data may be made available to entities located outside the European Union or the European Economic Area. Such entities may be located in countries where applicable data protection laws provide a lower level of protection than in your country of residence. When transferring data to countries outside the EEA whose level of data protection has not been deemed adequate by the European Commission, Don't Need No Samurai will ensure appropriate safeguards for Personal Data in accordance with regulations through the use of standard contractual clauses approved by the European Commission and other appropriate measures so that the level of protection of natural persons guaranteed by the GDPR is not compromised.

Profiling of Personal Data

Personal Data in the form of data entered into contact forms, chat, reviews, Account registration, and order placement will not be profiled. Personal Data collected through cookies, with the Customer's consent, may be processed for the purpose of presenting, creating, granting, and implementing advertisements, offers, or promotions regarding Don't Need No Samurai's products or services to the Customer, tailored to the Customer's preferences as a result of automated decision-making, which may produce legal effects or similarly significantly affect the Customer. Such an operation constitutes personal data profiling.

Customer Rights Regarding Personal Data Processing

Every person has the right to control the processing of data concerning them, including the right to request their update, correction, and deletion, the right to data portability, and the right to object to personal data processing – the exercise and scope of these rights are defined in the GDPR provisions. Requests for the exercise of rights may be submitted using the Controller's contact details (above).

Right of Access and Rectification

Every Customer has the right to access the content of their Personal Data, including in particular the right to information about: what Personal Data is processed by Don't Need No Samurai, where it comes from, what purposes it is used for, and information about the identity of persons/entities to whom the data has been transferred. The Customer also has the right to change the content of their Personal Data – to rectify inaccurate or incomplete personal data.

Right to Withdraw Consent

Every Customer has the right to withdraw any consent given to Don't Need No Samurai at any time, provided that the withdrawal of consent does not affect the processing carried out by the Controller lawfully before its withdrawal.

Right to Restriction of Processing

Every Customer has the right to restriction of processing when one of the circumstances provided for in Article 18 GDPR occurs, including in particular when the Customer contests the accuracy of personal data, processing is unlawful and the Customer opposes the erasure of personal data, requesting instead that their use be restricted, or the Customer has objected to processing – pending verification of whether the Controller's legitimate grounds override those of the Customer. If processing has been restricted, such Personal Data may, with the exception of storage, only be processed with the Customer's consent, or for the establishment, exercise, or defense of legal claims, or for the protection of the rights of another natural or legal person, or for reasons of important public interest of the Union or a Member State.

Right to Object

Every Customer has the right to object to the processing of their Personal Data carried out for the purpose of the Controller's or a third party's legitimate interests (if there are no other important legitimate grounds for processing that override the Customer's interests), including profiling based on those provisions. If Personal Data is processed for direct marketing purposes, the Customer has the right to object at any time to the processing of their Personal Data for such marketing purposes, including profiling, to the extent that processing is related to such direct marketing.

Right to Erasure

The Customer may request the erasure of their Personal Data when one of the circumstances provided for in Article 17 GDPR occurs, including in particular when Personal Data is no longer necessary for the purposes for which it was collected and there is no legally justified reason for further processing, or processing has become unlawful, or Personal Data must be erased for compliance with a legal obligation under EU or Polish law.

Right to Data Portability

Every Customer has the right to portability of Personal Data that they have provided to Don't Need No Samurai and that is processed by automated means, where processing is based on consent or on a contract. The Customer may also request that Don't Need No Samurai transfer the data directly to another data controller, where technically feasible.

Right to Lodge a Complaint

Personal Data Retention Period

Personal Data may be processed by Don't Need No Samurai for the following periods:

in the case of services provided through the Website – for the entire duration of the electronic services agreement; if the agreement is terminated, Personal Data will be stored for 3 years from the date of termination of the electronic services agreement;
for the time necessary to perform processing activities in connection with the processing purposes specified in this Privacy Policy – for the time necessary to respond to a question submitted via the form in the "Contact" tab, via chat, or to Don't Need No Samurai's email address – if the question does not give rise to a potential claim;
for the duration of Website use in the case of Personal Data in the form of Website usage data, operating system version data, screen resolution data, data collected using cookies or other technologies used to track User activity, device IP data, location data, web browser data;
in the case of consent for marketing purposes – from the time consent is given until its withdrawal, and if Personal Data is associated with the use of cookies and similar technologies, depending on technical aspects, until such files are deleted using browser/device settings (although deleting files is not always equivalent to deleting Personal Data obtained through those files, hence the possibility of objection);
if Personal Data is processed for the purpose of pursuing claims or defense against claims (e.g., in debt collection proceedings) – for the limitation period for claims resulting from the provisions of the Civil Code;
all Personal Data processed for accounting purposes and for tax reasons is processed for 5 years calculated from the end of the calendar year in which the tax obligation arose;
Personal Data will be processed by Don't Need No Samurai to the extent that the basis for processing Personal Data is the Customer's consent until its withdrawal, unless the period indicated above expires earlier.

After the expiry of the above periods, Personal Data is deleted or anonymized.

To ensure accountability of obligations under the GDPR, Personal Data may be stored indefinitely, although this will occur in exceptional situations (for example, in the case of an objection, Don't Need No Samurai will store Personal Data to demonstrate compliance with the User's request).

Cookies

Cookies are small pieces of text information in the form of text files, sent by the server and stored on the Online Store User's side (e.g., on a computer hard drive, laptop, or smartphone memory card – depending on what device the Online Store User is using). Cookies can be divided into first-party cookies or third-party cookies. Final Provisions

The Privacy Policy may be updated due to functional changes to the Website or changes in legal provisions. In such case, Don't Need No Samurai will publish the new privacy policy content on the Website. With each change, a new version of the privacy policy will appear with a new date.
